Fundesso processes your personal data for a limited list of purposes, each with a legal basis, as detailed below.

2.1. Personal data of prospects
Concerning prospects, Fundesso processes the personal data of prospects and, where applicable, their staff, for the following purposes: Responding to requests for information or questions from prospects received by Fundesso. The legal basis justifying this processing is Fundesso's legitimate interest in responding to prospects' requests and providing them with any necessary clarification. Conducting commercial prospecting by email or telephone with your professional email or telephone, obtained from you directly or indirectly. The legal basis justifying this processing is the legitimate interest of Fundesso in publicizing and promoting its services.
2.2. Personal data of borrowers
Regarding borrowers who have signed a loan contract with Fundesso, Fundesso processes their personal data and, where applicable, their staff's data, for the following purposes:

Verifications (identification, identity verification, and Know Your Client) related to the fight against money laundering and terrorist financing. The legal basis justifying this processing is the legal obligation of Fundesso to implement surveillance adapted to the fight against money laundering and terrorist financing.


The transfer of the above-mentioned verifications to the third party to the loan contract. The legal basis justifying this processing is the need for Fundesso to transmit the necessary documentation for the execution of the loan contract to which the person is a party.


The signing, monitoring, and execution of the loan contract concluded with Fundesso. The legal basis justifying this processing is the execution of the loan contract concluded with Fundesso.


The keeping and management of accounting related to the execution of the loan contract concluded with Fundesso. The legal basis justifying this processing is the legal obligation of Fundesso to keep accounts and retain the necessary supporting documents.

Management of pre-litigation, amicable settlements, and, where applicable, litigation. The legal basis justifying this processing is the legitimate interest of Fundesso to defend its interests and assert its rights in the event of a dispute or litigation.


5. Retention Period of Your Personal Data

Fundesso retains your personal data for a limited and proportionate period for the purposes described below. Regarding prospects, their personal data is kept for: Responding to inquiries from prospects, for as long as necessary for the response or provision of information. Commercial prospecting with data collected from them, for 3 years from the collection of data or the last contact from the prospect or as long as they have not opposed the use of their data for commercial prospecting.

With regard to borrowers and, where applicable, their staff, personal data is kept for:



The signature, monitoring, and execution of the contract concluded with FUNDESSO, for the entire duration of the contractual relationship, and, after its end, they are archived for the entire duration of the applicable legal requirement.


Invoicing and accounting relating to the execution of the contract concluded with FUNDESSO, for a period of ten (10) years in accordance with the provisions of article L. 123-22 of the Commercial Code.


Commercial prospecting, throughout the duration of the contractual relationship and, after its end, for a period of three (3) years.


Management of pre-litigation, amicable settlements and, where applicable, litigation, throughout the duration of the pre-litigation or legal procedure.


6. Recipients of Personal Data

Depending on the purposes mentioned in this policy, FUNDESSO may share your personal data with:

Duly authorized FUNDESSO employees and managers. Any FUNDESSO employee with access to your personal data is subject to strict confidentiality obligations.


Partners essential to the provision of FUNDESSO services such as, without this list being exhaustive, our payment partner, our collection partners in the context of dispute management or unpaid debts.


Service providers to perform services relating to FUNDESSO services, in particular email sending providers.


Competent authorities where applicable, such as public authorities and administrative or tax authorities.


7. Transfers of Your Data outside the European Economic Area (“EEA”)*

As part of the processing of your personal data for the purposes listed in this privacy policy, FUNDESSO uses service providers who are located outside the EEA.
